“Due to the imminent launch of Universal Jobmatch, below is a draft letter for Jobcentre Plus:

Dear Jobcentre Plus,

RE: Recruitment job search and match web sites

Can you write to me with guidance on when I fully register and use recruitment job search and match web sites like monster.co.uk, jobsite.co.uk, fish4.co.uk, indeed.co.uk etc I will be required, as a mandatory condition of my Jobseekers Allowance (JSA) to:

1. Become a Government Gateway registered user of the new DWP Universal Jobmatch (UJ)?
2. Provide Jobcentre Plus (JCP) staff with my unique Government Gateway registered ID?
3. Allow DWP and JCP staff access to my UJ account?

4. Please provide me with a copy of your internal guidance or other local JCP office instructions issued to frontline JCP staff/advisers that my JSA will not be sanctioned if I only consent to register with monster.co.uk, jobsite.co.uk, fish4.co.uk, indeed.co.uk and not UJ?

In your reply please note the following information published by the DWP on UJ:

“Requiring Jobcentre Plus customers to use the Services

10.7 When the Services are implemented, Jobcentre Plus customers (including potential jobseekers) will not be mandated to register and create a profile…”

6. So I can understand UJ from a fully informed consentpoint of view, can you please advise what happens if I give the DWP or JCP access to my UJ account, what exactly will they be able to see and do?

7. If a job is advertised on UJ and I want to apply to the employer will you be able to provide me with the employer’s contact details so I can apply direct without having to use UJ?

8. When a JCP or DWP staff member informs me of a suitable job on UJ, will I be sanctioned if I choose not to use UJ to apply for the job but prefer to apply direct to the employer?

9. If DWP or JCP staff refuse to provide me with the details of any employer advertising a suitable job on UJ, will I sanctioned if I do not consent to use UJ to apply because the DWP or JCP staff refuse to let me make the Job application without using UJ?

10. If I give DWP or JCP staff access to my UJ account does this currently or may in the future mean your external contractor’s staff , like those delivering the Work Programme, will also have the same degree of access?

11. If you issue a Jobseeker’s Direction to register with UJ, please explain in writing how this would be reasonable if I do not give consent to accept tracking cookies in accordance with my ‘EU e-Privacy Directive’ rights?

With regards:

“Q8. Does everyone have to register to search for jobs?
No, but if not, jobseeker’s will not be able to access all the facilities listed in question 7.”

This is only concerned with being able to search for jobs without having a Universal Jobmatch account or being logged into one. Applying for a UJ advertised job is likely to require registration, if details cannot be accessed in any other way. Q8 is merely highlighting a part of the DWP contract specification which requires:

“10.2 The Contractor shall ensure that the online Services will enable jobseekers to conduct an anonymous job search(es)”

By itself Q8, does not indicate people on JSA will or will not be expected to register on UJ, either on an explicit mandatory basis or by being given instructions by JCP like:

In summary Q8 is not a UJ registration get out clause, it is merely a technical answer about “anonymous job search(es)”. Just like searching for a product on amazon.co.uk does not require an account, but purchasing the product does.

The DWP is due to publish it’s privacy impact assessment on UJ and to date it has not indicated whether as a matter routine it will be requiring people on JSA to register with UJ on a mandatory basis, they have indicated though that they could issue a Jobseeker’s Direction to register:

Whilst registration may be compulsory it remains unclear whether consent is required to allow JCP and DWP direct access to a registered UJ users account.

“…we expect most JSA claimants will register willingly.However, where registration is deemed by a Jobcentre Plus adviser as reasonable in terms of improving employment prospects, but the claimant will not do so willingly, the adviser will be able to require registration through the issue of a Jobseeker’s Direction.”

If someone registers with the likes of monster.co.uk, jobsite.co.uk, fish4.co.uk, indeed.co.uk etc it might not be reasonable to additionally be issued with a Jobseeker’s Direction to register with UJ.”
