Universal Jobmatch website – Terms and Conditions for Employers
1. Information

1.1 This website is managed by Monster Worldwide Ltd on behalf of the Department for Work and Pensions (DWP).

1.2 The purpose of this site and service includes being a self-service venue for:

1.2.1 Employers to post jobs and search for and evaluate job candidates;

1.2.2 Jobseekers to post CVs and Profiles and to search for and evaluate jobs.

1.3 In this document, “Our”, “Us” or “We” means Monster Worldwide Ltd and/ or DWP.

2. Your obligations

2.1 When using this service you may access or follow links to other online services. These other services may be provided by other government departments, agencies or authorities. Each of these services may have its own Terms and Conditions or licences that apply only to that service and the people that use it. If you use any service you should make sure that you have read all of the terms and conditions for that service.

2.2 You must take reasonable care to prevent the spread of any software contamination including computer viruses when using this site.

2.3 You agree not to:

2.3.1 use this site unless you are aged 16 years or over. If you are under the age of 18 you must be supervised by a parent, legal guardian, or other responsible adult;

2.3.2 send, post, distribute, store or destroy information, to or on the site, that breaks our Privacy Policy or without prior permission from Us, or by the person whose information is concerned, or which breaks the laws of England and Wales or Scotland;

2.3.3 take any action that puts an unreasonable or overly large load on the site’s infrastructure;

2.3.4 use any device to navigate or search the site other than the tools available on the site, generally available third party web browsers, or other tools approved by Us;

2.3.5 use any data mining, robots or similar data gathering or extraction methods;

2.3.6 break or attempt to break the security of the site including attempting to probe, scan or test the weaknesses of a system or network or to break security or authentication measures without proper authorization;

2.3.7 forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting;

2.3.8 reverse engineer or decompile any parts of the site;

2.3.9 aggregate, copy or duplicate in any manner any of the content or information available from any site, including expired job postings, other than as permitted by these Terms and Conditions;

2.3.10 frame or link to any content information available from the site, unless permitted by these Terms and Conditions;

2.3.11 post any content or material or information that promotes or approves false or misleading information or illegal activities, or approves or provides instructional information about illegal activities or other activities not allowed by these Terms and Conditions;

2.3.12 share your login credentials to the site with anyone else;

2.3.13 access data not intended for you, or log into a server or account which you do not have permission to access;

2.3.14 post or submit on the site any incomplete, false or inaccurate information about yourself or your business or information which is not your own or make or use false identities or accounts when using any part of the service;

2.3.15 post content that contains limited or password-only access pages, or hidden pages or images;

2.3.16 remove or alter any content or information posted by any other person or business without their permission;

2.3.17 harass, incite harassment or advocate harassment of any group, company, or individual;

2.3.18 send unwanted mail or email, make unwanted phone calls or send unwanted faxes promoting and/or advertising products or services to any person that uses the service, or contact any person that uses the service who has asked not to be contacted by you;

2.3.19 attempt to damage hardware or software of Ours or other people that use the service, or interfere with service to any other person that uses the site, host or network, including by (without limitation) sending a virus or other software likely to expose weaknesses or damage to the site, overloading, “flooding”, “spamming”, “mailbombing” or “crashing” or attempt to get around functionality designed to protect the privacy and security of any user;

2.3.20 promote or approve an illegal or unauthorised copy without permission of another person’s copyrighted work, by providing or making available pirated computer programs or links to them, providing or making available information to avoid manufacture-installed copy-protect devices, or providing or making available pirated music or other media or links to pirated music or other media files;

2.3.21 use this site for any other unlawful purposes;

2.3.22 carry out any actions in relation to this site if you have received a request from us to stop those actions;

2.3.23 try to change or add to the content of the site unless We have given you specific permission to do so.

3. Your rights

3.1 In these Terms and Conditions the “Contents” means designs, text, graphics, images, video, information, logos, button icons, software, audio files and other content. Subject to clauses 3.1.1 and 3.1.2., we give you permission to access and use the sites and Contents and to download and print the Contents available on or from the site solely for your personal and non-commercial use.

3.1.1 The Contents of the site are protected under copyright, trademark and other laws. Unauthorised use of the Contents may be in breach of these laws and is strictly prohibited.

3.1.2 You may not use any of the Contents on any other website or in a networked computer environment, which includes (but is not limited to) uploading or republishing the Contents on any Internet, Intranet or Extranet site or incorporating the Contents in any other database. 4. Our obligations

4.1 Subject to the following provisions in clause 4.2, We will do our best to make sure that content on this site is correct and up to date. If we have missed out any information or any mistakes are identified We will correct it as soon as possible.

4.2 We cannot guarantee the availability or accuracy of data and information in the following cases:

4.2.1 on any linked website and We are not responsible for the results of you using the information or services on linked websites;

4.2.2 that the links to any linked websites will work all of the time;

4.2.3 of any particular service either provided by Us or by another government department, agency or authority.

4.3 A link to another website does not mean that We have checked the information given or that We approve or support any specific commercial product or business on that site. You must decide whether the information or service on that website is suitable for your needs. If a website is not linked to Ours this does not mean that we think that the information on it is not useful or correct.

4.4 In the interests of all the people that use the site we will co-operate with investigations by any law enforcement agency or relevant authority where they are investigating suspected criminal activity or violation of computer systems or networks.

4.5 We, Our suppliers and Our employees will not pay damages for any loss that you may suffer because:

4.5.1 of any failure by Us to comply with these Terms and Conditions, where it is because of circumstances out of our reasonable control;

4.5.2 of a withdrawal of this service;

4.5.3 you have used, or relied on the accuracy of, the information on Our service; or

4.5.4 disruption to your computer system or damage or loss of data caused by using this website or as a result of having used the website. It is your responsibility to have adequate security protection on your computer against viruses, malicious codes and similar threats.

4.6 We deny any responsibility for any postings or transmissions on this service which are unlawful, defamatory, obscene, offensive or scandalous, or any material that constitutes or encourages, or is likely to encourage conduct that breaches the law in any way.

4.7 We will not be contractually bound by any of your actions or statements.

4.8 If you make a complaint We will follow our standard complaints procedures in respect of job advertising.

5. Our rights

5.1 We may make changes to these Terms and Conditions at any time. If We decide to change the content of these Terms and Conditions, You will be asked to accept the new Terms and Conditions the next time you visit the site.

5.2 We may remove the service at any time without notice.

5.3 If you breach the Terms and Conditions We may, without notice:

5.3.1 remove your details from the site and/ or stop you from using the site;

5.3.2 edit your details held on the site.

5.4 Where We do not pursue any rights available to us under these Terms and Conditions on any occasion, this does not mean that We will not pursue those rights in the future.

6. Data protection

6.1 Information you provide to Us may be passed to relevant service providers, including government departments, agencies or authorities, for example in order to respond to any query you have made with Us or process any application you may have made. Your information will be managed in accordance with the law, including the Data Protection Act 1998. For further information please read Our Privacy Policy.

6.2 We will comply with our legal obligations to keep your information safe and secure, but we cannot guarantee the absolute safety of any information that you send to us. This means that you send Us information at your own risk. We will not pay you any damages to cover any loss that has resulted from someone accessing the service without permission or making changes to information on the site, except for where Our employees or agents are at fault.

7. User content

7.1 “User Content” means all information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages or other materials, submitted, posted or displayed by you on the site.

7.2 User Content is the sole responsibility of the person from which the User Content originated. The person who submits User Content retains all patent, trademark and copyright to the User Content they submit and that person is responsible for protecting those rights. However, you agree not to breach the patents, trademarks and copyrights of other users of the site, and a breach of those rights will be a breach of these Terms and Conditions.

7.3 If you submit User Content to this site you grant Us a worldwide, non-exclusive, royalty-free licence to reproduce, adapt, distribute and publish the User Content through this site.

7.4 We claim no ownership or control over any User Content. We have no obligation to check the content of User Content, unless we receive a complaint in relation to specific User Content.

7.5 We reserve the right to refuse to accept, post, display or transmit any User Content as we choose.

7.6 We do not guarantee the truthfulness, accuracy, or reliability of User Content or of any other information supplied by other users of this site. We do not we approve any opinions made by people using this site. If you rely on any of the information posted by other people using this site you do so at your own risk.

8. General

8.1 This service and the use of it are governed by English Law. The English Court system shall have exclusive authority over any disputes connected to or arising out of the use of this service.

8.2 If you use information or services provided on the site from outside the UK, you do so at your own risk and you are responsible for checking local laws and not doing anything to break them.

9. Additional terms for employers, advertisers and recruiters

9.1 You agree that jobs you advertise on this site will:

9.1.1 provide a full, clear and accurate job description, which is clearly understandable to jobseekers, of an actual job or work opportunity;

9.1.2 provide a rate of pay equal to, or more than the national minimum wage, unless a lawful exemption applies;

9.1.3 advertise only jobs that are lawful, including ensuring that they meet Equality Act 2010, health and safety legislation, Working Time Regulations 1998 and Sunday Trading Act 1994 requirements, as amended or replaced from time to time;

9.1.4 be available to jobseekers on an open and fair basis;

9.1.5 have a contract in place with the end employer when the job is being advertised on behalf of another employer (e.g. recruitment agency or job board);

9.1.6 not be duplicate jobs

9.1.7 clearly state if the job is for homeworking. The successful applicant must not incur any costs in order to carry out the work.

9.1.8 not use 0871, 0872, 0873 telephone numbers where the call duration exceeds 5 minutes.

9.2 You agree not to include the following in a job posting:

9.2.1 any hyperlinks, other than those where we have specifically given permission;

9.2.2 premium rate or mobile phone numbers, unless we have specifically given permission;

9.2.3 income generating phone numbers (070 and 09 prefixes);

9.2.4 material or links to material that takes advantage of people in a sexual, violent or other manner, or solicits personal information from anyone under 16;

9.2.5 requests for job seekers to use their own personal auction listing account(s) for placing jobs through this service, for auction listers.

9.3 You agree not to advertise the following types of jobs on this site:

9.3.1 jobs for sexual services or seeking employees for jobs of a sexual nature. Any jobs placed within the adult entertainment industry must only be for the purposes of a) selling, manufacturing and distributing of adult entertainment products b) Ancillary staff e.g. cleaners and bar staff and c) jobs must display the age requirement of 18 or over. No other adult entertainment jobs will be accepted;

9.3.2 jobs for franchise, pyramid scheme, “club membership”, distributorship, or multi-level marketing opportunities, or sales representative agency arrangements;

9.3.3 any business opportunity that requires an up front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;

9.3.4 any business opportunity that pays commission only, unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the jobseeker would be selling. Acceptance of these Terms and Conditions confirms the assurance that the business opportunity will achieve achieve a wage equivalent to the National Minimum Wage;

9.3.5 jobs that endorse a particular political party, political agenda, political position or issue;

9.3.6 jobs that promote a particular religion;

9.3.7 jobs that involve fundraising without the express permission of the charity involved, unless the employer has a valid exemption;

9.3.8 jobs that are specifically intended to provide cover for workers involved in an official trade union dispute;

9.3.9 jobs that involve community/voluntary/foster caring activities which do not pay the minimum wage. Jobs which offer allowances or expenses must not be advertised through this service;

9.3.10 jobs which ask for a financial commitment as a requirement of the application process. If any costs are to be incurred by the successful applicant this must be clearly stated (for a CRB check etc);

9.3.11 jobs which involve a trial or probationary period without pay, unless agreed with Jobcentre Plus.

9.3.12 jobs that require citizenship of any particular country or lawful permanent residence in a cou ntry as a condition of employment, unless otherwise required in order to comply with law, regulations, or government contract;

9.3.13 jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job;

9.3.14 Except where allowed by applicable law, post jobs which require the applicant to provide information

(i) racial or ethnic origin
(ii) political beliefs
(iii) philosophical or religious beliefs
(iv) membership of a trade union
(v) physical or mental health
(vi) sexual life
(vii) criminal offences or pending proceedings (subject to the Rehabilitation of Offenders Act)
(viii) gender
(ix) age

9.4 You agree that CVs sent to you:

9.4.1 will be used and handled in accordance with privacy and data protection laws;

9.4.2 will not be used for any purpose other than as a way for you to identify potential employees or workers.

9.5 You agree not to contact jobseekers unless it is about a job and they have indicated that they are willing to be contacted. You agree to only contact them in the manner that they have specified they wish to be contacted.

9.6 You agree that you will carry out all necessary pre-employment checks required for jobs involving working with vulnerable people or groups. The safeguarding Vulnerable Groups Act 2006 (and its equivalent in Scotland) provides details of the requirements.

9.7 Personal information should only be collected from jobseekers where there is a legitimate reason to do so. This type of information includes (a) National Insurance Number; (b) Passport details; (c) Bank Account details; (d) evidence showing entitlement to work in the UK.

9.8 You agree that if you are acting as a Gangmaster you must be registered with the Gangmaster Licensing Authority and have a current licence in place before placing any jobs on the service.

9.9 You are responsible for your posting and the management of your account. If We are asked to pay damages because we have advertised your posting or because of the way you have managed your account on the site you agree to pay those damages back to Us.

9.10 We may limit the amount of information (including CV views) that may be accessed by you in any given time period.

9.11 When your account is closed all of the information in it, including saved CVs, network contacts and email mailing lists may be marked as deleted by Us and removed from Our databases. Information may continue to be available for some period of time because of delays in processing the closure.

9.12 You shall take appropriate physical, technical and administrative measures to protect the data You have obtained from loss, misuse, unauthorised access, disclosure, alteration or destruction.

9.13 If you are placing a job outside the British Isles, it must meet all relevant legislation in the country hosting the job.

9.14 All apprenticeship jobs must contain the word ‘Apprenticeship’ in the job title.

9.15 The apprenticeship job description must include the qualification that the apprentice will work towards, the length of the apprenticeship and the name of the employer.

9.1 To register with this site or to use certain services and tools you will need to hold an existing Government Gateway online account or register for a Government Gateway user ID and password (for further information see our Privacy Policy).

9.2 You are responsible for the form, content and accuracy of any CV or other information that you place on the site.

9.2.1 your CV must not include links to other sites, photographs or videos;

9.2.2 you must not post CVs on behalf of another person;

9.2.3 you must not set more than one CV to be public at one time.

9.3 We will never ask you for your password. If you are asked for this by someone phoning or emailing you, you must not give it to them. If you think that your user ID and password has been or may be used by another person without your permission please report this to us immediately at UNIVERSAL.JOBMATCHTANDCS@DWP.GSI.GOV.UK

9.4 It is your responsibility to manage your account, including checking the progress of your applications. We cannot retrieve any information you delete from your account. We cannot protect you from unwanted emails that you may receive that may advertise products or services for sale, although We can choose to restrict the number of emails which an employer may send to you.

9.5 It is your responsibility to make sure that any job you are applying for complies with legal requirements. This means you must check that:

9.5.1 the job pays at least the national minimum wage level, unless there is a lawful reason for it not doing so;

9.5.2 you are aware of what your responsibilities will be to pay your own National Insurance Contributions and income tax if you are applying for a self-employed job;

9.5.3 you are aware of your rights with jobs that ask you to make a financial commitment if you are successful in applying for them. You must only pay such a fee if your application has been successful and you may wish to get independent financial/legal advice before doing so;

9.5.4 you are aware of your rights with jobs that ask you to pay for an enhanced or standard Criminal Records Bureau disclosure check. We ask employers to make it clear in the job description if jobseekers are expected to meet the cost of this disclosure;

9.5.5 you are aware of your rights in relation to homeworking jobs. You should never be asked to make any kind of financial commitment for this type of job;

9.5.6 you are aware of your rights in relation to jobs which are commission only. Employers are asked to guarantee that as part of the terms and conditions of your employment that they expect the business opportunity to achieve a wage at least equivalent to the national minimum wage;

9.5.7 the job does not unlawfully discriminate against you on the grounds of your sex, race, age, religious belief, sexual orientation or because you have a disability or long term health condition that seriously impacts on your ability to carry out day to day activities. Some jobs are of a nature such that it is lawful to discriminate on these grounds, but if you are in doubt please ask for independent legal advice;

9.5.8 if you have not been offered a job or have not received a conditional job offer you are advised to check why an employer asks for personal information from you which could be used to commit fraud, e.g. your National Insurance Number, date of birth, Passport or Driving licence details, or your bank account details. If an employer cannot give a satisfactory explanation for why they need the information, or if you discover that your personal details have been used by the employer in a fraudulent manner, you are asked to provide us with details at UNIVERSAL.JOBMATCHTANDCS@DWP.GSI.GOV.UK

9.6 It is your responsibility to be aware of call rates that may be charged when you contact an employer.

9.6.1 Premium rate telephone number calls (0871, 0872, 0873) can cost up to 10p per minute from a BT land line (including VAT). The cost charged by mobile and other service providers may vary. As part of their terms and conditions for use of this site employers are asked to make sure that any call you need to make to them to apply for a job on these types of lines last for no longer than 5 minutes. If you take part in a call to an employer on a premium rate line that lasts for longer than 5 minutes you should report this to Us at UNIVERSAL.JOBMATCHTANDCS@DWP.GSI.GOV.UK

9.6.2 Telephone numbers prefixed with 070 or 09 are income generating telephone numbers, and are not accepted by this service. If you are asked to apply for a job advertised through this service via one of these types of numbers you should report this to Us at UNIVERSAL.JOBMATCHTANDCS@DWP.GSI.GOV.UK

9.7 You should not agree to use your own personal auction listing account(s) for employers placing jobs through this service for auction listers. If you are asked to use your own personal account(s) for such purposes you should report this to Us at UNIVERSAL.JOBMATCHTANDCS@DWP.GSI.GOV.UK

9.8 You agree that you have no ownership rights in your account and that if you cancel your account or your account is closed, all of your account information, including CVs, saved jobs and questionnaires may be marked as deleted and may be removed from our databases. Information may continue to be available for some period of time because of delays in processing. Third parties may retain saved copies of your information which they have downloaded from the site. We may delete your account and all of your information if you do not use this site at least monthly.

10. Additional terms for employers, advertisers and recruiters

10.1 You agree that jobs you advertise on this site will:

10.1.1 provide a full, clear and accurate job description, which is clearly understandable to jobseekers, of an actual job or work opportunity;

10.1.2 provide a rate of pay equal to, or more than the national minimum wage, unless a lawful exemption applies;

10.1.3 advertise only jobs that are lawful, including ensuring that they meet Equality Act 2010, health and safety legislation, Working Time Regulations 1998 and Sunday Trading Act 1994 requirements, as amended or replaced from time to time;

10.1.4 be available to jobseekers on an open and fair basis;

10.1.5 have a contract in place with the end employer when the job is being advertised on behalf of another employer (e.g. recruitment agency or job board);

10.1.6 not be duplicate jobs

10.1.7 clearly state if the job is for homeworking. The successful applicant must not incur any costs in order to carry out the work.

10.1.8 not use 0871, 0872, 0873 telephone numbers where the call duration exceeds 5 minutes.

10.2 You agree not to include the following in a job posting:

10.2.1 any hyperlinks, other than those where we have specifically given permission;

10.2.2 premium rate or mobile phone numbers, unless we have specifically given permission;

10.2.3 income generating phone numbers (070 and 09 prefixes);

10.2.4 material or links to material that takes advantage of people in a sexual, violent or other manner, or solicits personal information from anyone under 16;

10.2.5 requests for job seekers to use their own personal auction listing account(s) for placing jobs through this service, for auction listers.

10.3 You agree not to advertise the following types of jobs on this site:

10.3.1 jobs for sexual services or seeking employees for jobs of a sexual nature. Any jobs placed within the adult entertainment industry must only be for the purposes of a) selling, manufacturing and distributing of adult entertainment products b) Ancillary staff e.g. cleaners and bar staff and c) jobs must display the age requirement of 18 or over. No other adult entertainment jobs will be accepted;

10.3.2 jobs for franchise, pyramid scheme, “club membership”, distributorship, or multi-level marketing opportunities, or sales representative agency arrangements;

10.3.3 any business opportunity that requires an up front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;

10.3.4 any business opportunity that pays commission only, unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the jobseeker would be selling. Acceptance of these Terms and Conditions confirms the assurance that the business opportunity will achieve achieve a wage equivalent to the National Minimum Wage;

10.3.5 jobs that endorse a particular political party, political agenda, political position or issue;

10.3.6 jobs that promote a particular religion;

10.3.7 jobs that involve fundraising without the express permission of the charity involved, unless the employer has a valid exemption;

10.3.8 jobs that are specifically intended to provide cover for workers involved in an official trade union dispute;

10.3.9 jobs that involve community/voluntary/foster caring activities which do not pay the minimum wage. Jobs which offer allowances or expenses must not be advertised through this service;

10.3.10 jobs which ask for a financial commitment as a requirement of the application process. If any costs are to be incurred by the successful applicant this must be clearly stated (for a CRB check etc);

10.3.11 jobs which involve a trial or probationary period without pay, unless agreed with Jobcentre Plus.

10.3.12 jobs that require citizenship of any particular country or lawful permanent residence in a cou ntry as a condition of employment, unless otherwise required in order to comply with law, regulations, or government contract;

10.3.13 jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job;

10.3.14 Except where allowed by applicable law, post jobs which require the applicant to provide information

(i) racial or ethnic origin

(ii) political beliefs

(iii) philosophical or religious beliefs

(iv) membership of a trade union

(v) physical or mental health

(vi) sexual life

(vii) criminal offences or pending proceedings (subject to the Rehabilitation of Offenders Act)

(viii) gender

(ix) age

10.4 You agree that CVs sent to you:

10.4.1 will be used and handled in accordance with privacy and data protection laws;

10.4.2 will not be used for any purpose other than as a way for you to identify potential employees or workers.

10.5 You agree not to contact jobseekers unless it is about a job and they have indicated that they are willing to be contacted. You agree to only contact them in the manner that they have specified they wish to be contacted.

10.6 You agree that you will carry out all necessary pre-employment checks required for jobs involving working with vulnerable people or groups. The safeguarding Vulnerable Groups Act 2006 (and its equivalent in Scotland) provides details of the requirements.

10.7 Personal information should only be collected from jobseekers where there is a legitimate reason to do so. This type of information includes (a) National Insurance Number; (b) Passport details; (c) Bank Account details; (d) evidence showing entitlement to work in the UK.

10.8 You agree that if you are acting as a Gangmaster you must be registered with the Gangmaster Licensing Authority and have a current licence in place before placing any jobs on the service.

10.9 You are responsible for your posting and the management of your account. If We are asked to pay damages because we have advertised your posting or because of the way you have managed your account on the site you agree to pay those damages back to Us.

10.10 We may limit the amount of information (including CV views) that may be accessed by you in any given time period.

10.11 When your account is closed all of the information in it, including saved CVs, network contacts and email mailing lists may be marked as deleted by Us and removed from Our databases. Information may continue to be available for some period of time because of delays in processing the closure.

10.12 You shall take appropriate physical, technical and administrative measures to protect the data You have obtained from loss, misuse, unauthorised access, disclosure, alteration or destruction.

10.13 If you are placing a job outside the British Isles, it must meet all relevant legislation in the country hosting the job.

10.14 All apprenticeship jobs must contain the word ‘Apprenticeship’ in the job title.

10.15 The apprenticeship job description must include the qualification that the apprentice will work towards, the length of the apprenticeship and the name of the employer.
